End-User Licence Agreement
END-USER LICENCE AGREEMENT FOR YENKA SOFTWARE
Please make sure that you are happy with these terms before you install, use or copy the Yenka plug-in - because by doing so, you'll show that you accept these terms. If you don't agree to these terms, please remove the Yenka plug-in from your Computer.
We're using these definitions:
- The "Yenka plug-in" includes all associated files - including educational content, tutorials and user guides;
- "You" or "your" means the person or organisation who intends to use the Yenka plug-in;
- "Us", "we" or "our" means Crocodile Clips Ltd, of 43 Queensferry Street Lane, Edinburgh EH2 4PF, Scotland;
- A "Computer" is a workstation, terminal or other device on which the output of the Yenka plug-in can be displayed.
How you can use the Yenka plug-in
Provided you accept these terms, Crocodile Clips grants you a limited, non-exclusive licence to use those parts of the Yenka plug-in for which you have been granted a valid licence by us or one of our authorised representatives. The ways in which you're allowed to use the software are governed by the sort of licence you've been granted.
- If you have a School Site Licence, you can use the Yenka plug-in on all computers located at a single postal address of an educational establishment as long as the total number of students on the roll doesn't exceed the upper limit of the Enrolment Band. Employees of the Licensee can also use the School Site Licence on Computers at home.
The Enrolment Band is displayed in the Licence Details which are accessible from the Help menu of the Yenka plug-in. The Enrolment Bands are:- Small: 1-599 pupils on school roll
- Medium: 600-1199 pupils on school roll
- Large: 1200+ pupils on school roll
- If you have a Teacher Home Licence, you can use the Yenka plug-in for evaluation, and to learn about how to use it, but only on a single computer at your private home address. This licence is only valid if you live in an eligible region, and only if you're a teacher or lecturer employed at a recognised school, college, or university.
As part of your Teacher Home Licence, you may also pass on a Student Activation Key, but only to current students who attend your school.
The Teacher Home Licence does not permit the Yenka plug-in to be used for teaching or tutoring, preparation of lessons, industrial or commercial purposes. Also, it doesn't allow use at school, or in any other organisation.
When you have a Teacher Home Licence, the Yenka plug-in will need to connect to the internet during use, and will need to be verified each year.
- If you have a Student Home Licence, you can use the Yenka plug-in for evaluation or for your own learning, but only on a single computer at your private home address. This licence is only valid if you live in an eligible region, and only if you're a student who physically attends a recognised school, college, or university.
You may not pass on your Student Activation Key to anyone else.
The Student Home Licence does not permit use of the software at school, or in any other organisation.
When you have a Student Home Licence, the Yenka plug-in will need to connect to the internet during use and the software must be re-activated each year.
- You are not eligible for a Teacher Home Licence or Student Home Licence if you are in one of the following regions: Asia, Portugal, Saudi-Arabia, Slovenia, Spain, or Turkey.
- Both the Teacher Home Licence and the Student Home Licence are valid only for the English language version of the Yenka plug-in.
- Both the Teacher Home Licence and the Student Home Licence are granted at Crocodile Clips' sole discretion, and we reserve the right to terminate these Licences and hence your use of the Yenka plug-in at any time.
If you want teachers or students to be able to use the Yenka plug-in at your school, you must purchase a School Site Licence. A School Site Licence will also allow teachers to use the Yenka plug-in to prepare lessons at home.
- If a licence is provided to you for evaluation, it may only be used for this purpose, and not for teaching or studying. Evaluation licences cannot be extended for use outside of the organisation to which they were granted.
- When you upgrade, this Licence Agreement replaces any earlier licence agreements.
What you can and can't do with the Yenka plug-in
With any of the licence types listed above, you can:
- make a copy of the Yenka plug-in, but only for backup purposes.
However, you are not allowed to:
- make any other copies, or distribute or make available any copies at all, of the Yenka plug-in
- rent, lease, loan, sublicense or distribute the Yenka plug-in, or otherwise use it for commercial gain;
- broadcast the output from the Yenka plug-in beyond your Institution, or create works based on it or featuring it;
- reverse engineer, decompile, disassemble or modify the Yenka plug-in, or any part of it;
- use the Yenka plug-in on unlicensed computers, or computers outside of the licensed postal address;
- use those parts of the Yenka plug-in for which you have not been granted a valid licence.
Other terms
The Yenka plug-in, and all of the files and intellectual property associated with it, is entirely owned by Crocodile Clips and its licensors. It is protected by international copyright law and applicable national laws.
For licences which have been purchased, we warrant that the Yenka plug-in will perform substantially in accordance with the Help for a period of ninety days from purchase. Our entire liability, and your only remedy, shall be, at our sole discretion, either the return of the price you paid or a replacement delivery of the Yenka plug-in to you. This limited warranty is void if the failure of the Yenka plug-in is a result of an accident, abuse or misapplication.
To the maximum extent permitted by law, we disclaim all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose with regard to the Yenka plug-in and accompanying materials.
To the maximum extent permitted by law, we shall not be liable for any other damages whatsoever arising out of the use or inability to use the Yenka plug-in, even if we have been notified about the possibility of such damages.
If you do not comply with any of these terms and conditions, we may terminate this Licence to use the software. In such an event, you must destroy all copies of the Yenka plug-in and all of its component parts.
